3.1 - Platform Performance

Recrugate cannot be held responsible for any errors, system slowdowns, or inability to use the Platform due to the devices and/or internet connections used by Members. The Member accepts that access to the Platform may be temporarily blocked to implement improvements and other changes to the Platform.

3.2 - Disclaimer

Recrugate or its group companies, affiliates, subsidiaries, directors, representatives, employees, or other representatives shall not be liable in any way for any direct, indirect, special, incidental, consequential, punitive, and/or exemplary damages, including but not limited to loss of profit or income, loss of data and/or loss of business, arising in connection with the use or inability to use this Platform or reliance on its content, even if Recrugate has been advised of the possibility of such damages.

3.3 - Information Accuracy

Recrugate does not guarantee the validity, accuracy, or currency of the information on the Platform. Members must verify the accuracy of the information before making decisions based on the information on this Platform.

3.4 - Warranty Disclaimer

All information provided on this platform is provided "as is" without any warranty, guarantee, or commitment. To the fullest extent permitted by law, Recrugate expressly disclaims all express, implied, statutory, or other warranties, guarantees, or commitments, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

3.5 - Content Management

Recrugate reserves the right to remove or change content on the Platform at any time and for any reason.

3.6 - Platform Security

In cases that constitute a violation of the obligations specified in this Membership Agreement or the general rules announced on the Platform (such as using software that threatens the general security of the Platform, prevents the operation of the Platform and the software used, attempts to perform such activities, and obtaining, deleting, or modifying information), Recrugate may block the use of the Platform for the real/legal person(s) involved, reserving its legal rights.

3.7 - Illegal Use

It is prohibited to use the Platform or its content for illegal purposes, to access any part of it using an automatic mechanism such as a robot or worm, or to copy and monitor it for commercial/non-commercial purposes.

3.8 - Third Party Links

This Platform may contain links to third-party websites, but Recrugate is not responsible for any content on these websites. You may need to review and approve the applicable terms of use when using such websites. Also, a link to any third-party website does not mean that Recrugate endorses the site or the products or services mentioned on the site.

4.1 - Registration Information

To create a Platform membership account, the information in the relevant registration form must be entered completely, accurately, and up-to-date. Recrugate cannot be held responsible in any way for incomplete, incorrect, or outdated information entered in the registration form.

4.2 - Security and Privacy

The Member accepts that all responsibility for the security, storage, and keeping system access tools (username, password, etc.) used to benefit from the services offered by Recrugate via the Platform away from third parties lies entirely with them. It is the Member's responsibility not to share credit card or other payment instrument information with third parties and not to define such information on the Platform used by third parties.

4.3 - Username Selection

When choosing a username, the Member may not (i) select or use another person's username to impersonate someone else; (ii) select a username subject to any rights of another person without proper authorization; or (iii) use an offensive, rude, obscene, or illegal username. Recrugate, at its sole discretion, reserves the right to cancel or refuse any username registration that it believes violates this Membership Agreement, Company policies, or laws.

4.4 - Platform Access

After creating a membership account, Members can use the Platform by logging in with their username/contact address and password and approving this Membership Agreement. Users without a membership account can view the public sections of the Platform and use public services.

4.5 - Profile and Information Upload

After completing the registration process, Members can upload information of their choice in the permitted area to introduce themselves and include experience and resume information to benefit from the services offered on the Platform. Members can update the information they have uploaded to the Platform at any time. Members are responsible for the accuracy and currency of the information uploaded to the Platform. Neither Recrugate nor third-party employers to whom Members' information is shared are obliged to verify the accuracy of this information.

4.6 - Information Sharing

Information shared by Members may be shared with companies, firms, and/or groups of companies offering job opportunities, subject to the candidates' approval. Members have the right to withdraw their approval for positions they have approved for application at any time.

4.7 - Confidentiality Obligation

Members shall not share any information, documents, or other content obtained within the scope of the Services offered on the Platform with third parties.

4.8 - Account Responsibility

Members are directly responsible if the username, password, and similar information and usage rights given to them or determined by themselves are shared with third parties or organizations (including malicious use of the password by others). Likewise, Members may not use another person's IP address, email address, username, or other information on the internet, nor access or use other users' data without permission. Login information must be used by only one person; multiple people are not allowed to use a single login. Members are solely responsible for any legal and criminal liability arising from such use.

5.1 - Content Responsibility

The responsibility for content provided by Platform Members lies solely with the Member providing such content. In this context, it is the Members' responsibility to ensure that all rights and permissions required for the use of the content in connection with the services within the Platform have been obtained. Recrugate is not responsible for any actions taken by Members regarding the content, the content itself, or reliance on the content.

5.2 - Content Review

Recrugate may need to review content to determine whether it is legal or violates this Membership Agreement (such as when illegal content is reported to us) and to comply with legal obligations. Recrugate may also modify, delete, or block access/viewing of content that it believes violates laws or this Membership Agreement.

5.3 - Prohibited Content

Members may not share comments, posts, or other content in the following scope in transactions carried out via the Platform:

• Any content that is objectionable or illegal.
• Content that is harmful, insulting, damaging to personal rights, and/or offensive to other users and/or third parties.
• Content that threatens any person or institution.
• Content that is aggressive or harmful to any person.
• Content that disturbs or may disturb the general user base.
• Content that is irrelevant to the topic and page content, shared repeatedly by a single user.
• Identical content shared by one or more users (spam).
• Advertising content on behalf of another brand or institution.
• Any comments, links, and content that support and encourage illegal activities.
• Any content that violates the rights of any third party or institution.

5.4 - Content Guarantees

Members are solely responsible for any content provided to the Platform. Members declare, acknowledge, and undertake that any uploaded content (i) complies with the law; (ii) does not violate any rights of third parties, including intellectual property rights; and (iii) they have all rights and authorizations necessary to provide the content.

5.5 - General Code of Conduct

In all transactions carried out on the Platform, the Member agrees, declares, and undertakes to comply with the Membership Agreement and other provisions that may be published on the Platform from time to time, laws, morality and decency, principles of honesty, not to engage in behaviors that may hinder the operation of the Platform by any means, and not to commit acts that infringe or may infringe the rights of third parties.

5.6 - Usage Restrictions

In addition to all other terms and conditions in this Membership Agreement, Members must comply with the following conditions:

• You will not transfer or otherwise offer the use of the Services/Platform to any third party;
• You will not provide any service based on the Services/Platform without prior written permission;
• You will not send links to third-party sites or use their logos, company names, etc. without prior written permission from third parties;
• You will not publish/share any personal or confidential information belonging to any person or institution without the permission of the relevant person or institution;
• You will not use the Services in any way that may damage, disable, overload, disrupt, or harm any server, network, computer system, or resource of Recrugate.

5.7 - Prohibited Activities

The following actions are prohibited in the scope of access and use of the Platform:

• Using the Platform for fraudulent or otherwise unfair or illegal purposes.
• Continuing to use the Platform despite the removal of the authorization to use the Platform for any reason.
• Attempting to gain unauthorized access to the Platform.
• Performing vulnerability or similar tests for the Platform.
• Collecting or attempting to collect information about other users of the Platform.
• Interfering with or disrupting the operation of the Platform or the servers or networks used to make the Platform available, including hacking or tampering with any part of the Platform, or violating any requirement, procedure, or policy of such servers/networks.
• Restricting or preventing another person's use of the Platform.
• Reproducing, modifying, adapting, creating derivative works from, selling, renting, lending, or otherwise using any part of the Platform (or any use thereof) without the authorization of Recrugate.
• Reverse engineering, decompiling, or disassembling any part of the Platform.
• Engaging in any conduct that violates copyright, trademark, or other proprietary rights.
• Using the Platform/content to develop a product or service that serves the same or similar purpose or otherwise competes with the Platform.
• Members are responsible for providing and maintaining all hardware, telecommunications, and other services required for the use of the Platform.

6.1 - User Content

Content you provide via the Platform: Except for the limited rights that allow us to provide services to you via the Platform, you retain the intellectual property rights to the content you provide to us or the Platform. In other words, the relevant content and related rights belong to you, but we need to obtain certain permissions from you to process, maintain, store, reproduce, back up, distribute, and ensure that our related operations do not violate copyright and other laws. Therefore, you grant us a non-exclusive, worldwide, royalty-free, transferable, and irrevocable license to use, reproduce, and display your content to provide services to you via the Platform.

6.2 - Recrugate Content

Content belonging to Recrugate: All registered or unregistered intellectual property rights such as titles, business names, brands, patents, logos, designs, information, and methods on this Platform belong to Recrugate, the operator and owner of the Platform, and are protected under national and international law. Visiting or using this Platform does not grant any rights regarding such intellectual property rights.

6.3 - Usage Restrictions

The whole or any part of the Platform may not be used on another website/media without permission or in violation of the rules specified herein.

6.4 - Technical Protection

It is prohibited to use the design, source codes, interface, content, or database of the Platform in whole or in part, as is, modified, or differentiated.

7.1 - Data Processing

As a result of activities such as using or visiting the Platform and creating a membership account, personal data of natural persons may be processed. For detailed information regarding the processing of your personal data, please review the Candidate Membership Form Clarification Text if you are registering as a candidate, or the Company Employee Membership Form Clarification Text if you are registering as a company employee.

7.2 - Information Accuracy

The Member accepts that all information provided within the scope of using the Platform is always and in all respects complete, accurate, and up-to-date. The Member accepts that if there is any change in the information, they will update such information via the Platform without delay.

8.1 - Agreement Effectiveness

This Membership Agreement enters into force on the date it is published on the Platform by Recrugate. Members are deemed to have accepted this Membership Agreement and any changes made over time by opening a membership account on the Platform.

9.1 - Applicable Law

This Membership Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey.

9.2 - Jurisdiction

Istanbul (Central) Courts and Enforcement Offices are authorized for the resolution of disputes arising from the implementation of this Membership Agreement.

9.3 - Evidence Agreement

The Parties accept that in any dispute arising from the Membership Agreement, Recrugate's official books and commercial records, electronic information kept in its database and servers, computer and audio records shall constitute evidence, and that this article is in the nature of an evidence agreement within the meaning of Article 193 of the Code of Civil Procedure.

9.4 - Notifications

All notifications to be sent to the Parties regarding this Membership Agreement shall be made via the email address(es) of the Members registered with Recrugate.
