These Terms of Service ("Terms", "Agreement") govern your access to and use of RecruGate ("Platform", "We", "Us"), an AI-powered recruitment, candidate pool management, and interview simulation Software-as-a-Service (SaaS) platform. By visiting, registering, or using our Platform, you agree to be bound by these Terms.

1. Scope of Service & Definitions

RecruGate provides a digital recruitment platform that connects employers ("Employer Users") and job seekers ("Candidate Users") using artificial intelligence algorithms for resume parsing, candidate matching, skill evaluation, and automated interview screening.

2. Account Registration & User Responsibilities

• Account Security: You are responsible for maintaining the confidentiality of your account credentials (email and password). You are fully responsible for all activities that occur under your account.
• Accuracy of Information: Employer and Candidate users warrant that all job postings, profile details, resumes, and corporate information provided to the Platform are accurate, current, and lawful.
• Age Requirement: You must be at least 18 years old or possess legal capacity in your jurisdiction to use our Platform and Services.

3. Prohibited Activities

When accessing or using the Platform, you agree NOT to:

• Copy, scrape, or extract Platform data using automated bots, scrapers, or software.
• Interfere with, compromise, or disrupt the security, infrastructure, or server performance of the Platform.
• Publish misleading, discriminatory, copyright-infringing, or unlawful content and job postings.
• Collect or process personal data of other Platform users without authorization.

4. Subscriptions, Payments & Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

• Payment Infrastructure: Subscription and service payments on RecruGate are processed securely through our online reseller and Merchant of Record, Paddle.com.
• Automatic Renewal: Recurring subscription plans automatically renew at the end of each billing cycle unless cancelled by the user prior to the renewal date.

5. Intellectual Property Rights

All rights, title, and interest in and to the RecruGate software, design, source code, AI algorithms, trademarks, and logos belong exclusively to RecruGate. Users are granted a limited, non-exclusive, non-transferable right to access and use the Platform during their active subscription term.

6. Limitation of Liability

RecruGate makes reasonable efforts to ensure Platform availability and AI accuracy. However, AI matching scores and screening insights are advisory in nature. The final hiring decision rests solely with the Employer. RecruGate shall not be liable for any indirect, incidental, or consequential damages resulting from service interruptions or third-party data loss.

7. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy and Personal Data Protection Policy.

8. Modifications & Governing Law

RecruGate reserves the right to modify these Terms of Service at any time. Revised terms become effective immediately upon posting. These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, with Istanbul Courts having jurisdiction over any disputes.
