User Agreement (Candidate)

I. TERMS OF USE AND MEMBERSHIP AGREEMENT

By clicking "Sign Up", "Complete Membership", "Sign Up with Facebook", "Sign Up with Linkedin", "Sign Up with Google" or similar expressions, registering, accessing, or using our services, you enter into this legally binding Terms of Use and Membership Agreement ("Agreement") with us, RecruGate. If you do not accept the terms and conditions in this Agreement, do not create a membership, access, or use any of our services.

For information about your rights regarding the processing of your personal data, and for information about processing and requested consents, you can review the "Clarification Text" and Section VI of the Agreement.

Candidates are deemed to have read all the conditions written below regarding the use of the platform on recrugate.com, wwww.recrugate.com domain or mobile application, and to have accepted these conditions in advance.

II. OUR SERVICES

This Agreement applies to all services ("Services") expressed to be provided under this Agreement, including employment-related services currently provided via the platform on recrugate.com, wwww.recrugate.com domain or mobile application, as well as data collection within the Platform and research and marketing activities outside the Platform. Registered users seeking jobs are called "Candidate", and registered users seeking employees are called "Employer Customer". This Agreement applies to Candidates.

III. TERMS OF PLATFORM USE

  • The Candidate hereby authorizes Recrugate to create an account and profile for them using all information provided in the membership form ("Form") and resume shared on the Platform. The Candidate is personally responsible for any legal, criminal, and/or administrative liability arising from the information in the Form and resume.
  • As a rule, Candidates are not expected to share special categories of personal data during membership. However, if the Candidate includes special categories of personal data in their resume or Form in any way, the Candidate is deemed to have consented to the processing of such data.
  • Even if the Candidate terminates their membership, Recrugate may continue to retain the personal and special category personal data shared during Platform membership in accordance with legal obligations.
  • If at any time the Candidate requests the deletion, destruction, and/or anonymization of general and/or special category personal data obtained and/or recorded by the Employer Customer, they will submit this request directly to the relevant company, and accepts in advance that Recrugate has no responsibility or obligation in this regard.
  • The Candidate must keep their personal data shared on the Platform up-to-date and accurate, and may update their resume(s) at any time. The Candidate accepts in advance that, upon updating their resume(s), the Employer Customer will see the latest updates in all job applications made before and after the update.
  • The Candidate may delete their application to an Employer Customer within 48 hours, provided the company has not viewed the application.
  • With the "Open Resume" feature on the Platform, the Candidate may, entirely at their own discretion, make selected information (personal and/or special category personal data) in their resume publicly searchable online, and may disable this feature at any time. However, while enabled, the Candidate accepts in advance that their resume information and thus their general and/or special category personal data will be publicly accessible, and that Recrugate has no responsibility or obligation regarding personal and/or special category personal data made public in this way.
  • The Candidate may add a video to their resume. If a video is added, the Candidate accepts in advance that the video and all general and/or special category personal data shared via the video will be viewable by companies to which job applications are made and by companies reviewing resumes in the resume pool (if the Candidate has made their resume visible to all companies).
  • If the Candidate uses the Recrugate mobile application, IP, Device ID, operator information, and device information (version-model) are transmitted to and recorded by Recrugate. The Candidate accepts this in advance upon starting to use the mobile application. The purpose of collecting this information is to intervene in technical problems and understand their source.
  • As long as the Candidate sets their resume as "active" and does not restrict its visibility, they accept in advance that personal information and resumes on the Platform may be viewed by site users.
  • Recrugate has no responsibility for the content, accuracy, confidentiality, and/or protection of any information entered by the Candidate by following links provided on the Platform. In any case, Recrugate declares that it has taken all necessary measures to ensure the security of personal data and, if shared, special category personal data processed and shared on the platform.
  • Recrugate is not obliged to verify the accuracy of information provided by the Candidate or included in the resume uploaded to the Platform. The Candidate is solely responsible for the accuracy of the information provided.
  • The Candidate accepts in advance that all information in their resume shared during membership may be viewed by companies publishing job postings and by persons authorized by those companies.
  • After applying to any job posting published on the Platform, the Candidate accepts in advance that all responsibility regarding the transferred normal and/or special category personal data passes to the Employer Customer, and that Recrugate has no obligation and/or right to intervene regarding information transferred via the application. Similarly, if the Candidate requests the deletion, destruction, and/or anonymization of general and/or special category personal data transferred to the Employer Customer via a job application at any time, they must submit this request directly to the posting company. The Candidate accepts in advance that Recrugate has no responsibility or obligation in this regard.

IV. COMMUNICATION WITH THE CANDIDATE

Recrugate has the right to send messages, SMS, and emails to the user via the email address or phone number specified in the Candidate's registration form or later updated by the Candidate within the scope of the membership relationship. In addition, if the Candidate explicitly consents, the Company may send promotional, marketing, advertising, etc. SMS and emails to the Candidate for commercial communication purposes. By accepting this Agreement, unless otherwise notified, the Candidate accepts and declares that Recrugate may engage in the above-mentioned communication activities. The Candidate can unsubscribe from the email list with a single click via account settings or the "Unsubscribe" link in the email sent.

V. YOUR OBLIGATIONS

If you violate any of the obligations below and Recrugate suffers any damage, including damages to third parties, Recrugate may claim such damages from you or take legal action to recover the damages, and may suspend or close your account, provided that you are informed when necessary. Recrugate evaluates the legality of the information you provide and your compliance with your obligations, considering your fundamental rights and freedoms such as freedom of expression and reasons for legality such as public interest.

  • All personal data you enter on the Platform must be accurate and up-to-date.
  • You must verify your personal data if requested by Recrugate.
  • If your personal data needs to be changed or updated, you must update the relevant sections. Otherwise, such information will be deemed accurate.
  • You undertake not to share personal data provided to you during application processes with unrelated third parties and/or not to process it for purposes other than intended.
  • Your account belongs to you. Therefore, you agree to (1) choose a strong and secure password; (2) keep your password safe and confidential; (3) not give any part of your account to others; and (4) comply with laws and the Agreement. Except for system-related reasons beyond your control, you are responsible for all actions taken with your account, even if you have taken all reasonable precautions.
  • You may not create fake accounts using information belonging to any other person on the Platform.
  • Information you enter on the Platform, including your resume, must not be misleading or false, must not contain statements that defame any third party including former employers, violate fundamental rights and freedoms, or cause unfair competition. If such information is detected, Recrugate reserves the right to cancel/suspend membership.
  • Unless necessary and appropriate, you may not include personal data of unrelated third parties, especially special category personal data, in your resume or on the Platform, nor violate confidentiality agreements with any legal or natural person.
  • You may not include content on the Platform that constitutes insult, slander, threat, etc. under Turkish Penal Code No. 5237.
  • You may not include content that encourages or supports illegal or criminal acts or organizations.
  • You may not open multiple accounts for deception, misleading, unfair gain, or other reasons, sell your account, or allow others to use your account for their own or third-party benefit.
  • You may not include content that infringes third-party intellectual property rights such as trademarks and copyrights.
  • You accept and undertake that the data of persons you list as references are shared in accordance with the knowledge and consent of the reference person, and that you are responsible for all claims and requests of the reference owner to the contrary.

VI. PROCESSING OF PERSONAL DATA

You can find detailed information about which personal data we process and for what purposes in the "Clarification Text". As a rule, special category personal data is not requested from Candidates during membership. However, Candidates may, at their own discretion, include special category personal data among their membership information. Under KVKK, your race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and clothing, association, foundation or union membership, health, sexual life, criminal conviction and security measures, and biometric and genetic data are your special category personal data.

If you share with us, the special category personal data that may be subject to processing and the processing methods are as follows:

"Personal Information" section in your resume

When specifying your military status, you are asked to provide an explanation. The information you provide here may reflect your political and philosophical views (such as conscientious objection) or your health status (such as exemption reasons).

"Additional Information" section in your resume

Your blood type, communities you are a member of, and smoking status. In addition, information you write in the hobbies/interests section may also contain special category personal data if you share it.

Information you provide in the "Add Your Information" section of your resume may also be defined as special category personal data under KVKK.

Some employers, mostly due to their field of activity, may request some of your special category personal data. Therefore, to show the necessary sensitivity in processing your special category personal data, a separate tab has been created in your resume for the "Personal Information", "Additional Information", and "Add Your Information" sections mentioned above, which may contain special category personal data. Before filling out this tab, explicit consent is requested from you in a separate checkbox for the processing and transfer of your special category personal data.

Your personal data and, if you share, your special category personal data are shared with employers via the information in your resume to assist both your job search and employers' employee search. Employers process this data for their own recruitment processes.

VII. TERMINATION

This Agreement will remain in effect as long as the Candidate is a member and will continue to have effect and consequences between the Parties. If the Candidate leaves membership or their membership is suspended temporarily or permanently, the Agreement will be deemed terminated. If the Candidate violates this Agreement or certain rules regarding membership and services, Recrugate may unilaterally terminate the Agreement, and the Candidate will compensate Recrugate for all damages incurred due to the act(s) causing termination.

VIII. FORCE MAJEURE

In all cases legally considered force majeure, Recrugate does not accept any responsibility for late or non-performance of obligations under this Agreement. In such cases, the Candidate may not claim any compensation from Recrugate for delay, non-performance, or default. The Candidate accepts and declares this in advance.

IX. APPLICABLE LAW AND JURISDICTION

Disputes arising from the use of the services in this Agreement are subject to Turkish Law, and Istanbul Central (Çağlayan) Courts and Enforcement Offices are authorized.

Recrugate may amend the provisions of this Agreement at any time; any changes will be published and become effective on the same date.
